Do not include on line 24h attorney fees and court costs for actions involving certain unlawful discrimination claims to the extent the gross income from such actions is not effectively connected. If you checked the Married filing separately box at the top of page 1 of Form 1040-NR, you cannot take the student loan interest deduction. Do not use your spouse’s earned income, or your or your spouse’s alimony and separate maintenance payments, when determining whether you can take the IRA deduction. Under Article 21 (Students and Trainees) of the income tax treaty with France, Jean can exempt up to $5,000 of personal services income from U.S. tax.
